Most families discover how Indian succession law actually functions in the corridors of a hospital or outside a branch manager’s cabin. By then, grief is compounded by an endless parade of indemnities, court fees, and administrative gridlock.
Sorting out an estate is not an exercise in morbid contemplation. It is an act of basic civic courtesy to those who Will survive you.
Here is the straightforward operational blueprint for organizing bank accounts, investments, corporate holdings, and end-of-life medical decisions under current Indian law.
The most pervasive financial myth in India is that a “nominee” inherits the money. In nine out of ten situations, they do not.
Bank Accounts and Fixed Deposits: Under Section 45ZA of the Banking Regulation Act, a nominee is merely a collection agent—a trustee holding funds on behalf of your Legal Heirs. To make or alter nominations, banks use Form DA 1 (register), Form DA 2 (cancel), or Form DA 3 (change). While online banking allows quick updates, the legal reality remains: unless backed by a clear Will, the proceeds still belong to the estate’s statutory heirs. And whether you can leave a will and to what extent favouring whom is decided by applicable Personal Law.
Under Section 39 of the Insurance Act (amended in 2015), if you designate your spouse, children, or parents as nominees, they become “Beneficial Nominees.” By statute, the payout belongs to them outright, overriding claims from other legal heirs or creditors.
If you have older policies, log into your insurer’s portal or visit the branch to confirm your beneficial nominees are accurately recorded.
Paper trails across fund houses and depositories create the messiest bottlenecks during probate.
Demat PortfoliosElectronic Securities AccountsDematerialized accounts holding securities (shares, bonds, mutual funds) in electronic form, managed by depositories like CDSL and NSDL.: Both CDSL and NSDL allow up to three nominees per account, with specified percentage allocations. This can be executed online via broker portals using Aadhaar e-Sign.Mutual Funds: If your folios are scattered across multiple fund houses, avoid chasing each AMC separately. Use MFCentral, the joint platform built by CAMS and KFintech, to audit and update nominations across every folio in a single digital submission.
Physical Share Certificates: If you or your parents still hold physical paper shares, time is running out.
SEBI requires Dematerialization for any market transfer. Physical nominations require Form SH-13 submitted directly to the relevant Registrar and Transfer Agent (RTA), supported by Form ISR-1 and ISR-2 for signature and KYC validation.
Do not leave physical scrips in steel cupboards; demat them now.
Statutory savings do not automatically merge into a standard bank liquidation:
Employees’ Provident Fund (EPF): You cannot rely on the original physical declaration signed at your first job. Log into the EPFO Unified Member Portal and file an E-Nomination. It requires your nominee’s Aadhaar details and photograph, finalized via OTP e-Sign.
Public Provident Fund (PPF): Governed under the Government Savings Promotion rules via Form E. Submit this directly to the specific bank or post office branch housing the account.
National Pension System (NPS): Accessible directly through the CRA system (Protean or KFintech) under Demographic Changes. Update the nominee split online without branch visits.
Flats in Cooperative Societies: In states like Maharashtra, Gujarat, or Telangana, submitting a society nomination form (such as Form Appendix 14/15) allows the managing committee to transfer the share certificate and maintenance ledger to the nominee.
However, societies increasingly demand Succession Certificates or registered wills if multiple heirs assert claims.
The Master Title Dossier: No land or property transitions cleanly without original parent documents. Collate your registered sale deeds, development agreements, encumbrance certificates (EC), mutation extracts (Pahani/Khata), and up-to-date property tax receipts in one indexed physical binder.
Until recently, making a binding medical decision about withholding artificial life support was buried under impossible judicial red tape.
Following the Supreme Court’s streamlined guidelines in the \*\Common Cause\\* matter, an Advance Medical Directive (Living Will) is practical, recognized, and enforceable.
If you do not want your body kept artificially functioning on an invasive ventilator during irreversible coma or terminal brain death, you must document it in advance.
The Declaration: A written document explicitly stating that life-prolonging treatments (ventilators, feeding tubes, external resuscitation) should not be deployed or should be withdrawn if two medical panels confirm you are in a persistent vegetative state or terminal condition with zero realistic hope of recovery.
The Proxy: Name one or two trusted family members or friends who are legally empowered to interpret and execute your instructions with the hospital.
Attestation: Sign the document in the presence of two independent witnesses, and have it authenticated before a Notary Public or a Gazetted Officer.
You no longer need to wait on a Judicial Magistrate for authentication.
Distribution: Hand one copy to your chosen person, keep one in your personal medical file, and provide a copy to your family physician. You can also link it to your ABHA ID (Ayushman Bharat Health Account) under the National Digital Health Mission.
When an ICU team is presented with this directive, hospital administration must convene an internal Primary Medical Board (three doctors), followed by concurrence from a Secondary Medical Board, allowing the designated person to sign the release without frantic court petitions.
Do not attempt to tackle everything in an afternoon. Break it down:
Day 1: Run a nomination audit on net banking, MFCentral, and your demat platform. Submit missing nominees online.
Day 2: Draft your Will and Advance Medical Directive. Schedule an appointment with a local notary for attestation.
Day 3: Assemble the physical folder containing title deeds, policy bonds, a list of active bank accounts, and your digital access directives. Tell your designated executor exactly where the folder sits.
Leaving a clear roadmap is not a concession to mortality. It is simply good housekeeping.
Jai Hind
